Your Right to Privacy with Trak Recruiting

Respect for a candidate’s privacy has always been a priority for Trak Recruiting comprising Trak Executive, Trak Retail, Trak Sales & Marketing & Trak FMCG. The National Privacy Principles established by the Privacy Act 1988 (introduced in December 2001) merely reinforces our approach & practice.

During our recruitment process we need to collect personal (& at times sensitive) information. We collect information about you by asking questions during an interview (either face-to-face or over the phone), by reading your resume, by conducting reference checks, through psychological/medical tests, or other related processes This could include receiving information from former employers, work colleagues, professional/academic associations, etc.

The type of information collected will include “personal information” (defined as factual, everyday data e.g. address, telephone number, previous employers & positions). It also includes the opinions of others about your work performance (whether true or not), your experience, qualifications, aptitude test results & other information obtained by us in connection with your possible work placement.

At times, we may also become aware of “sensitive information” which is a special category of personal information & includes: racial or ethnic origin; political opinion &/or membership of a political association; religious beliefs, affiliations or philosophical beliefs; membership of a professional or trade association or membership of a trade union; sexual preferences; criminal record; health or disability. Any such information will at all times be handled in accordance with anti-discrimination legislation. Sensitive information can, in most cases, only be disclosed with your consent.

The primary purposes, for which we collect, hold, use and disclose this information includes evaluation for, and possible placement in a new position. During the recruitment process, data about you may need to be disclosed to any of the following: employers, members & clients of The Trak Group; referees; our insurers; a professional association or registration body with a proper interest in the disclosure of personal & sensitive information; a Workers Compensation body; our contractors & suppliers e.g. our IT contractors, or any person with a lawful entitlement to obtain the information.

Information may be kept on hard copy (in our office) or soft copy (on our data base). In both cases appropriate measures are taken to ensure this information is secure and only accessible to those mentioned. As we believe the information collected may be important in determining your suitability for future positions, (not just the immediate role to which you may have applied), we retain the information for an indefinite period unless you specifically instruct otherwise.

If you do not give us the information we seek we could be limited in our ability to locate suitable work for you or introduce you to a potential employer. Subject to some exceptions set out in the National Privacy Principles you have a right to see and obtain a copy of information that we hold on you. If you are able to establish that this information is not accurate, complete and up-to-date, we will take reasonable steps to correct it.
